THE COURT FINDS AND IT IS HEREBY ORDERED THAT:
1. White Star Mining LLC is a qualified contract mining company.
2. White Star Mining LLC is capable of mining coal from property on which the
Debtor has mined and has interests in permits and rights to mine.
3. It is in the best interest of Creditors of Gwenco Inc. for Gwenco to enter into said
Agreement so that White Star Mining LLC can produce coal and generate funds from which
Creditor's claims can be repaid.
4. Gwenco Inc.'s entry into said Agreement and White Star Mining's production of
coal provide adequate protection for the interests of all Creditors by maintaining and
increasing the value of Gwenco Inc.'s assets.
5. The relief requested is necessary to protect the assets of the Debtor; to maintain
safe conditions on the site; and to prevent irreparable damage from mine flooding and
improper ventilation if utilities and maintenance fees are not maintained by qualified
personnel.
