doch schon gewöhnt ,es ist wie es ist,der Frühling kommt noch für uns.

Seifert hat sich halt verzockt ;-)  

ob ein aufwendig aufgesetztes Programm mit zahlreichen Lenders an einer Wurstbude , die noch nicht mal gesicherte  Ansprüche stellt, scheitern würde. Wer das glaubt, dem ist echt nicht mehr zu helfen...

Positiv ist das nicht. Abee bislang hat sich nur ein angeblicher Gläubiger gemeldet, der vorher offenbar nicht bekannt war. Das kann am Ende ein Mini-Gläubiger sein, der aber natürlich den ganzen Restrukturierungsprozess aufhält.

es wird wohl die unten genannte LSW GmbH sein, die in der heutigen adHoc ist; Herr Andreas Seifert ist dort Geschäftsführer ...

SEAG Proposal:
"LSW Claim
Pursuant to the SEAG Restructuring, the claimant under the LSW Claim shall, in the event that such claim is finally determined or resolved in its favour (in whole or in part), subject to certain terms and conditions, receive an entitlement on a pro rata basis in the New Lux Finco 2 Loans under the LSW Accordion facilities (as detailed further in paragraph 35.4.4 (LSW accordion facilities)). The LSW Claim is asserted as arising jointly and severally against SEAG and AIH and provisions are included in the accordion facility such that the claimant under the LSW Claim cannot recover twice in respect of the same claim. The Company will be restricted under the terms of the New Lux Finco 2 Loans from unreasonably prolonging or delaying the progress of the LSW Claim proceedings."

dem seifert sollte schon bewusst  sein, dass früher  oder später irgendwer auch seine rolle im ganzen durcheinander hier unter die lupe werden nehmen wird. und auch von anderen natürlich, insbesondere denjenigen, welche frühzeitig short gegangen sind und eine menge kohle gemacht haben, zum beispiel  die jungs von viceroy. von denen  hat man auch nichts mehr gehört.

wenn die interne aufarbeitung  erstmal abgeschlossen ist, dann wird steinhoff seine juristenschar auf die externen player loslassen, soviel ist jetzt schon klar.

wer sonst außer Seifert, nur wegen Ihm wahrscheinlich der Umzug nach UK und das dortige Recht bei dem 75% reichen. Seifert gibt alles !  

SEAG CVA Proposal
35.4.4 LSW Accordion:
The New Lux Finco 2 Loans each include an LSW Accordion facility in aggregate up to the full determined value of the LSW Claim. The LSW Accordion facilities may only be drawn following the full and final determination or resolution of the LSW Claim in whole or in part in favour of the claimant and subject to satisfaction of certain conditions. The LSW Accordion facilities, if drawn, will form part of the B1 and B2 tranches of the New Lux Finco 2 First Lien Loan and the New Lux Finco 2 Second Lien Loan (respectively). In such circumstances, the deemed proceeds of the LSW Accordion facilities will be lent to the Company and the Company shall apply the proceeds in settlement of the LSW Claim. No cash will move as a result of these transactions and the resultant intercompany loan. It is anticipated that the resultant intercompany liability owing between the Company and Lux Finco 2 and any recourse claim or right of contribution or indemnity or equivalent claim the Company may have against AIH in respect of the LSW Claim (together with the benefit of any
security granted by AIH in favour of the Company) will then be hived down to Newco 5.

dass so einer wie sefert die ganze konsolidierung und neuaufstellung verhindern kann. das ist nur störfeuer eines ins abseits geratenen....sh hat sich mit sicherheit darauf vorbereitet....und der kurs ist ja nachbörslich um sagnehafte 0,2 cent gesunken.....und das auch nur bei lump&schnulli
als ob das sh aufhalten könnte ...eugentlich witzig...
der soll sich schon mal warm anziehen, wenn die ersten forderungen an ihn herangetragen werden ^^

werd noch schnell short gehen...
