Das ABK in CH11 ist weiß ich schon 

die Firma an die Gläubiger verschiebt. Genau aus diesem Grund ist ja der Aktionär und Rechtsanwalt Friedberg mit einem Antrag in das Aktionärskommitee bzw. stellt die Ansprüche der Aktionäre.

Erstmal danke für die Antwort, hatte schon befürchtet das meine Frage nicht ernstgenommen wird.

Die Gläubiger bekommen dochh nur soviel wie sie investiert hatten, richtig? Kannst du abschätzen wie das Verhältnis der Ansprüche der Gläubiger zu dem Vermögen von Ambac aussieht?

Ch7, die bei den Eigentümern liegt.

Noch mal ganz deutlich. Es gibt eigentlich kein Eigentümerkommitee und genau dies ist die Gefahr das AMBAC an die Gläubiger verschoben wird. Aus diesen Grund hat der Rechtsanwalt und Großaktionär Friedberg sich ins Kommitee der Eigentümer per Gerichtsbeschluss eingesetzt. Nur der Vorstand und die VangardGroup (Fonds) vertreten die Eigentümer.

In CH11 müssen die Kreditgeber bedient werden, oder die Kredite wieder sicher nach Finanzplan bedient werden können.

CH11:
1. Erst wird der Staat bedient
2. Die Banken
3. Die Gläubiger
4. Die Eigentümer

In dem Fall bei AMBAC reicht bei einer Auflösung das Geld bis einschließlich den Eigentümern. Das hat ja Friedberg angemerkt. Im Schnitt haben die Aktionäre (wenn auch nicht persönlich) einst $10 pro Aktie eingezahlt und würden $15 +x ausgezahlt bekommen, bei einer Auflösung.

Statutische Reserven 8 Mrd
- 2 Mrd an Bankenkredite
- 1,6 Mrd an Gläubiger
- x ? Policeholder akutell 229 Millionen und erhöht sich nach Zeit auf 1,2 Mrd
---------------
5 Mrd für die Eigentümer + Munibookverkauf (Wert liegt zwischen 5 und 40 Mrd)

Hoffe es geht hier mal etwas schneller bis die allgemeine Richtung klar wird. So ne jahrelange Warterei wie bei Wamu muß nicht sein.
Wenn ich mich recht erinnere war die letzte Schätzung das sich vor Mai dieses Jahr nix bewegt. War letztes Jahr nicht schlecht als der Kurs bei den AMIs mobil wurde. Hab meinen damaligen Gewinn leider durch die CH11 Meldung wieder verloren. Hoffentlich läufts dieses Jahr besser.

Es ging um die Steuerforderung des IRS von den Ambacs- Assets . Diese wurde von den US District-Gericht abgelehnt.

Nach der Ablehnung vom IRS-Antrag ist letze Hürde vor dem Reha. Prozess erfolgreich abgewendet.

Ich glaube, dass der Reh. Prozess spätestens  Ende des Januars oder Anfangs Februars zu ende ist.

 

- Nächste Hürde ist 700 milionen NOLs.  Das Insovenzgericht (CH11 court) wird sich diese Problematik entscheiden.

Wenn ja, dann ist am 19 Januar, wenn ich mich nicht irre, der Rehabilitierungsprozeß und dann kann AMBAC mit erfolg sogar CH11 wieder verlassen, wenn die Holding über ausreichend Geldzufluß verfügt.

.....eines Unwissenden. Ich bin erst heute auf diese Aktie (über WMI-Forum) aufmerksam geworden......

....meint Ihr nicht das hier genauso eine "LINKE" Tour abgezogen werden kann/wird wie bei "Washington Mutual"?

....und ob die Leute (selbst ernanntes EC ?) überhaupt von der Justiz wahrgenommen werden können/dürfen/wollen......

das ich erst heute auf AMBAC aufmerksam wurde, ist nicht ganz richtig......

In der Base (WAMU) wurde letztes Jahr schon mal drüber gesprochen/geschrieben......

allerdings war der Kurs damals bei weit über 1,-- und zweitens gab es noch keine Ch11 Anmeldung......

...und/allerdings bin ich "so gut wie voll in WAMU" drinn........(immer noch und bleibt auch so, aber kein Nachkauf mehr) :-)

Corporation’s holding company), and the United States are the only parties to this injunction.

D.h. ja!  AMBAC muß 700 Mio nicht rückzahlen. Ambac wurde auch unter diesem Antrag erwähnt und unter Schutz gestellt.

Das Ende des Reh. Prozesse vermute ich zwischen den 17.01-31.01.2011. Ich glaube auch, dass Rehab.Court  und OCI vor dem Januar komplette  zu Ende bringen .

sogar im Nowember hatte Dilweg erzählt, dass erste Rate an die Policyholders entweder Januar oder Februar ausgezahlt werden.

Ich hoffe alles wird gut.

 

Ich denke auch das es noch im Januar soweit sein wird. Denke da an den 19.1.

in diesem Jahr haben vier unterscheidliche insolvenz Firmen  unglaubliche Kursantieg geschafft.

Tria, Primacom, Arquana oder Mania

Einige sogar haben Rebound.

z.B Primacom. sie wurde sogar einer von den Gläubigern übernommen.und noch ihre alte Aktien ist aktiv!

Ich hoffe. es kann ähnliches auch für ambac passieren. Es gibt mehrere Möglichkeiten und indizien.

aber erst müssen wir Geduldig abwarten!

Die GM-Methode

Jetzt arbeitet die New Yorker Gesellschaft gemeinsam mit einem Ausschuss der Inhaber vorrangiger Anleihen an einer Umschuldung im Wege einer Prepackaged Bankruptcy. Das Verfahren stellt eine Möglichkeit dar, um Unternehmen besonders schnell und elegant in eine bessere bilanzielle Situation bringen zu können. Zuletzt hatte sich der Automobilkonzern GM dieses Verfahrens bedient und schon nach wenigen Wochen den Gläubigerschutz wieder verlassen können.

Diese Nachricht ist  ziemlich alt ( am 1.11.2010 und erzählt über Prepackaged Bankruptcy) sogar vor dem CH11. Trotzdem danke schön für die info.

Ambac macht ihre eigene Reorganization.

 

Bei GM sind die Aktionäre nicht besonders glücklich schätze ich, Stichwort Motors Liquidation.
Ist diese Prepackaged Bankruptcy bei ABK  ähnlich zu beurteilen, aus Aktionärssicht?

CH11 von GM ist für ambac irrelevant. Ich will nicht so viel tief bohren.

Aber kurz:

US Regierung hat GM geholfen, weil GM produkte nicht rentabel und effektiv waren, Ausserdem hatte GM viel Schulden.

Jetzt ist alte aktien wertlos. sie haben neue aktien in den Mark gebracht.

request seeking information related to the basis for the refunds, asking, among other things,
whether Ambac Financial had received advance permission from the IRS before changing its
accounting method. Within ten days, Ambac Financial filed for Chapter 11 bankruptcy
protection in the Southern District of New York and filed an adversary proceeding in the
bankruptcy court to determine its tax liability. (Ambac Financial is not in the business of
insurance and therefore not entitled to the protections of the rehabilitation proceeding.) The
action is pending. On November 7, 2010, Ambac allocated to its segregated account any
liabilities it has or may ever have arising from its federal taxes through December 2009 and
specifically any liabilities it may have with respect to the tax refund.

The Commissioner approved the allocation, filed a “notice” with the Dane County
court and served the notice on the United States on or about November 8, 2010, the same
day that Ambac Financial filed for bankruptcy. On the same day, the Commissioner
obtained an injunction from the Dane County court enjoining the United States from
initiating any type of lawsuit in regard to Ambac’s potential federal tax liabilities in any
court, administrative body or other tribunal against the segregated account or any subsidiary
of Ambac whose stock or other form of ownership interest were allocated to the segregated
account, to Ambac, to any subsidiary of Ambac or the rehabilitator

 

- Der Hauptgrund ist 700 Million dollar  Steuerforderung von IRS

- Unter anderem 708 millionen NOL blockade widerum  von IRS

- und letzte Ambac wollte bei der Reh. prozesse ihre eigene Anspruch auf den ACC assetment besser mit dem Schutz CH11 protection  erhöhen.
