Please take note of the following legal notice from our attorneys, as a condition of receiving this announcement:
“You are receiving this notice as a shareholder as it is your right to know what is going in with the company. However, please understand that the terms of the settlement are confidential and are not to be disclosed to anyone outside of the company. The profitability of the company could be affected by any disclosure of settlement terms."
For almost four years Wi-SKY has been engaged in litigation regarding ownership of the intellectual property rights pertaining to the air-to-ground radio system. I am pleased to announce that all lawsuits have now been dismissed by all parties and we have entered into a final settlement agreement. The implementation of the settlement will be under the jurisdiction of a US Magistrate judge, who will be the arbiter in this case.
As a broad summary of the settlement agreement, the intellectual property will be held by the inventor and his company. Wi-SKY will be paid a royalty of all gross revenue collected from the users of the ground-to-air radio system and radio business worldwide. In the judgment of our management team and at the recommendation of our attorneys, a royalty agreement was the best solution to this litigation.
When the deployment of the radio generates revenue for the manufacturer or its customers, a royalty will be paid quarterly to Wi-SKY Inflight and distributed according to the percentage of shares held by each shareholder. Since the air-to-ground radio business is not yet operational, it will be an undetermined period of time before there are royalty proceeds available to distribute to shareholders.
In the next several months we will be preparing our documents and records to have a CPA firm manage the royalty payment account and make the distributions. To those who had stock on the Frankfurt Stock Exchange but did not receive a paper stock certificate after trading ceased, please email us your latest brokerage statement to confirm how many shares you have remaining in your account.
Let me express my appreciation and congratulations to our attorneys at Harris, Penn and Lowry, LLP. The firm, with Darren Penn as the lead attorney on our case, has done an exceptional job in representing us in the many court venues in which we have been engaged.

Weiss jemand noch an welche Mail man den Auszug senden musste?
Das wäre sehr ärgerlich, wenn dies nicht funktionieren würde...

G. Sharp hat mir versichert, das Zertifikat in einer Woche zu senden. Nur war das vor etwa 5 Monaten. Inzwischen sicherlich 4 Mal geschrieben. Keine Antwort mehr...

Our settlement agreement requires reporting only quarterly. The first 2 quarters had no revenue on which to pay a royalty. I doubt there will be much revenue, if any, in Q3 which ends February 17th.
It takes them time to raise money to complete the radio development and then to get the necessary regulatory approvals for the radio. Thank you for inquiring. I will certainly inform all the shareholders when there is activity to report.

Hallo,
habe heute dieses Mail bekommen. Zusammengefasst ist das Vergleichsverfahren abgeschlossen und Wi-Sky erhält vierteljährlich eine Gebühr von der Gegenseite, da diese während des Rechtsstreites Mittel erwirtschaftet haben. Die ersten Lizenz-Zahlungen gehen an Gläubiger und Rechtsanwälte, danach sollen die Aktionäre bedacht werden. Wann das sein wird, ist nicht bekannt.Die Gegenseite hat augenscheinlich das ground to air System Fluggesellschaften angeboten, da weiterhin Interesse besteht, dieses System zu kaufen. Genaue Details dürfen nicht genannt werden.
Wie man das nun deuten soll, weiss ich auch nicht. Vermutlich wird es erst wieder interessant, wenn eine Fluggesellschaft tatsächlich kauft. Neuer Börsengang ? Zahlt Grant die Aktionäre aus ?

Vor allem dieser Teil ist mMn von Interesse:

Heisst, wenn sie Umsatz erwirtschaften wird die Abgabe an "uns", bzw. wie du richtig geschrieben hast, zuerst an Unternehmen, Anwälte, etc., fällig.
Mich würde insbesondere interessieren, ob diese vierteljährlichen Abgaben zeitlich beschränkt sind. Nehmen wir nämlich an, dass diese Technologie zum Fliegen kommt (..was für ein Wortspiel), dann könnte über lange Frist schon noch etwas aus den alten Aktien kommen.

Dazu folgendes aus meiner Sicht und meinem Verständnis:
- Sie haben sich geeinigt und es werden Lizenz- / Nutzungsgebühren fällig
- Die Gebühren fallen solange an, wie Erlöse erwirtschaftet werden, welche auf "unseren" Lizenzen basieren
- bisher wurden noch keine Erlöse erwirtschaftet, sondern die Gegenseite hat die Finanzmittel zusammengekratzt, um die Entwicklung zu finanzieren
- Zuerst werden Gläubiger und Anwälte ausbezahlt, entsprechend den Vereinbarungen von "Chapter 11"
- Die Gegenseite hat erkennen lassen, dass sie an den letzten Bedingungen für die Finanzierung feilen
- Es wird ein Umsetzungs-/Einsatzplänen mit einer oder mehreren großen (wahrscheinlich Lufthansa) gearbeitet
- Grant wurde untersagt weitere Informationen bekannt zu geben
- Er freut sich, dass wir in einer guten Position sind und sich die Risikofinanzierung, sowie auch die Entwicklungskosten doch noch auszahlen
- Bis sich die Umsetzung/Technik also zu weit von unserer Lizenz entfernt hat, sollten wir auf ewig quartalsmäßige Lizenzgebühren erhalten

Hallo zusammen,
ich schaue ab und zu mal hier im Forum nach, weil das hier noch die ergiebigste Quelle bzgl. Neuigkeiten zu Wi-Sky ist, die man ohne lange Nachforschungen konsultieren kann (in diesem Sinne auch noch mal ein Danke an alle, die hier posten). Und nach all dem, was ich hier so lese, stellt sich mir schon die Frage, ob irgendjemand von euch eigentlich auch einmal irgendetwas Handfestes bekommen hat (z.B. dieses ominöse Zertifikat über seinen Aktienanteil an Wi-Sky)?
Ich meine damit, dass auch ich (wie ihr alle) an Grant geschrieben habe, ich habe eine freundliche Antwort mit der Bitte um einen Nachweis meiner Aktien bekommen, ich habe ihm einen Depotauszug von mir geschickt, in dem die Aktien aufgelistet sind und das war es dann. So wie ich die meisten eurer Beiträge lese, geht es euch da ziemlich ähnlich.
Oder hat jemand vielleicht mal etwas bekommen, das zumindest entfernt an so etwas wie eine offizielle Verlautbarung der Firma erinnert (und sei es nur eine Rundmail). Es kann doch nicht sein, dass sich jeder Anteilseigner seine Informationen quasi häppchenweise persönlich abholen muss. Das kann doch auch nicht in Grants Interesse liegen, dass er dauernd Einzelmails beantwortet, anstatt (vielleicht einmal im Quartal oder gar halbjährlich, würde ja locker reichen) per Rundmail einen Wasserstandsbericht zu geben. Und wenn es nur die Nachricht ist, dass es nichts Neues gibt oder er es zumindest noch nicht sagen darf. Aber dann hätte man zumindest mal ein Lebenszeichen. Grant ist ja allem Anschein nach auch der einzige Punkt, bei dem die Fäden zusammenlaufen (auch das finde ich etwas merkwürdig).
Zusammengefasst habe ich ehrlich gesagt das Gefühl, dass, selbst wenn da irgendwann noch etwas bei herauskommt (eben diese "Gebührenzahlungen" zum Beispiel), dass diese dann schlichtweg an uns hier vorbeigehen werden, weil wir zumindest auf unserer Seite des großen Teichs quasi im Tal der Ahnungslosen sitzen.
Ist nur meine Meinung, wie seht ihr das?

Ich meine damit, dass auch ich (wie ihr alle) an Grant geschrieben habe, ich habe eine freundliche Antwort mit der Bitte um einen Nachweis meiner Aktien bekommen, ich habe ihm einen Depotauszug von mir geschickt, in dem die Aktien aufgelistet sind und das war es dann. So wie ich die meisten eurer Beiträge lese, geht es euch da ziemlich ähnlich.
Oder hat jemand vielleicht mal etwas bekommen, das zumindest entfernt an so etwas wie eine offizielle Verlautbarung der Firma erinnert (und sei es nur eine Rundmail). Es kann doch nicht sein, dass sich jeder Anteilseigner seine Informationen quasi häppchenweise persönlich abholen muss. Das kann doch auch nicht in Grants Interesse liegen, dass er dauernd Einzelmails beantwortet, anstatt (vielleicht einmal im Quartal oder gar halbjährlich, würde ja locker reichen) per Rundmail einen Wasserstandsbericht zu geben. Und wenn es nur die Nachricht ist, dass es nichts Neues gibt oder er es zumindest noch nicht sagen darf. Aber dann hätte man zumindest mal ein Lebenszeichen. Grant ist ja allem Anschein nach auch der einzige Punkt, bei dem die Fäden zusammenlaufen (auch das finde ich etwas merkwürdig).
Zusammengefasst habe ich ehrlich gesagt das Gefühl, dass, selbst wenn da irgendwann noch etwas bei herauskommt (eben diese "Gebührenzahlungen" zum Beispiel), dass diese dann schlichtweg an uns hier vorbeigehen werden, weil wir zumindest auf unserer Seite des großen Teichs quasi im Tal der Ahnungslosen sitzen.
Ist nur meine Meinung, wie seht ihr das?
