Folks. We are in the Ninth Inning here, we are pitching, have to get the 3 outs, so we can break the tie. The letter from David Hoffman is centering on one thing and one thing only.. It should be addressed by this court and with enough support it will.. Many of us are heavily invested in this case and will fight till the end. This is a fight against the corruption, collusion and breach of the Federal Government on a Solvent Bank and its holding company.
We can biatch and bicker all we want, but the one thing that stands in the way is a POR that wants to cancel our ownership rights. We have sent in letters to THJMW asking for a shareholder meeting and a clarification of the "clear abuse" statute in this case.
Now I ask of you one more thing before we get to Nov 9th.. I told many of you many months ago, that there would come a time where we would all have to band together and support through a collaborative effort our efforts as shareholders upon this court. David is touching upon a nerve that shareholders have been Po'ed about from the start and that is the "dark room deals and being shut out of the process." There is no transparency in this bankruptcy and it needs to stop. David makes a great argument, so as shareholders we need to support his argument, we deserve to know what is in the documents and why they are being kept from us.
Examiner report has some good points in it also, it has many avenues for Susman to head down. We should be aprised of what is transpiring and the sealed document is something we should know about..David has a Point..

I'm PO'ed. I want to see flames coming out Nelson or Sussman Ask on Nov 9th or before then. Otherwise, this board can go quiet.
Gut tells me that SG is waiting for Dec 1. You can see it in the billings. I'm not one to just sits. But, there nothing I can do right now, except call the UST to voice my frustration... Which I plan on doing.
Just So Everyone is aware, EC represents the EC shareholders -- not you as a shareholder. They are your best interested party, but they have their owns interests in mind!

This could be the evidence of "big rigging" in favor of JPM. Remember being an Attorney the examiner has to be careful of how he charges in certain circumstances. Many of you think this report was all bad, it was not. It has plenty of avenues for the EC to go down. You know it may just have exactly what they were looking for, we do not know until we see the filings from them..
Pages: 320-321 "Third, the evidence suggests that FDIC was less clear than it could have been in
informing potential bidders about the precise nature and understood value of assets that were to
be included in the purchase and assumption transaction. For example, Mr. Wigand stated that
the only discussion with all potential bidders regarding "tax refunds" was that "tax refunds"
would be an asset sold. There is, however, evidence suggesting that tax issues may have been
discussed between FDIC and JPMC before bids were due.1323 JPMC had insight from its prior
due diligence concerning tax refunds and other assets and may have been better informed than
other potential bidders as to what tax benefits were available from the purchase and assumption
transaction.
Similarly, FDIC appears to have conveyed very little information to potential bidders,
other than possibly JPMC, regarding the inclusion in the deal of the assets associated with the
TRUPS. While all bidders were "informed" in the Q&A that the assets associated with the
TRUPS were intended to be included in the sale, it appears that only JPMC had actual
discussions with FDIC in the days before bids were due regarding this valuable asset. 1324 No
witness the Examiner interviewed was able to recall the specifics of any discussions regarding
the TRUPS but JPMC took steps to make sure the TRUPS was included among the assets
sold.
