Ich empfehle mal www.kccllc.net/documents/0812229/0812229100826000000000003.pdf zu lesen. Ist schon interessant, was WMB an so einer Hypothek verdient hat, da das JPM jetzt verdient.

Diese Hypothek wurde in 2006 abgeschlossen, also als das Geschäft mit der Immobilienfinanzierung noch recht gut lief.

Ich habe von Dan Hoffman und Kevin Compton (WamuEquity RightsOrg) eine E-Mail erhalten, in dem der Link zu der Seite www.wamuequityrights.org/shareholders-meeting-action-fund.html an gegeben war.

(Holzi: Könntest du noch mal alle Infos zu dieser Spendensache hier einstellen und wie man das Geld überweist und wohin.)

Auf dieser Seite wird beschrieben, wie und warum man eine Spende für ein Shareholders' Meeting durchführt kann. Die Spende wird auf ein PayPal-Konto überwiesen. Ich nehme an, das jeder der bei Ebay was ersteigert hat und mal auf die Schnautze gefallen ist so eine Zahlungsmöglichkeit hat. Schnell, praktisch, sicher und bequem (Zumindest habe ich bis jetzt keine schlechten Erfahrungen mit PayPal (JPM) gemacht). Wer kein PayPal hat, wird durch anklicken eines Auswahlbutton auf eine andere Seite geleitet und man kann per Kreditkarte zahlen.
Ich bevorzuge PayPal.

Wenn es zu eine HV kommt, wird man vom Veranstallter durch seine Bank eingeladen. Wie bei allen anderen Aktien auch. Wahrscheinlich ist auch eine Verfügung für einen Stimmzettel dabei, damit man sei Stimmrecht an die Bank abtreten kann, wenn man nicht selbst zur HV anreisen möchte/kann. Ich würde jedem als WaMu Aktionär jedoch abraten die Verfügung zu unterschreiben, wenn die Hausbank JPM heißt. :-)))))

Wenn es also so weit ist, werden wir hier im Forum oder ich hoffe per E-Mail von WamuEquity RightsOrg oder auf deren Web-Seite informiert, wie man sein Stimmrecht an z.B. unser EC weiter gibt. Jedoch haben bereits 3500 Aktionäre das Stimmrecht an das EC abgegeben. Wir werden sicher noch erfahren ob nur die bereits ausgefüllten Stimmrechte zählen, oder ob ein neuer Stichtag vorgegeben wird.
Mein letzter Wissensstand ist der, dass nur diejenigen ein Stimmrecht haben, die die Aktien am Tag vor dem HV-Antrag hatten.

POR vom 21.05.2010 wird die Class-Definition der zu bedienten Forderungen in einer Reihenfolge dargestellt.
Das POR besteht aus mehreren Dokumenten/Inhaltsangaben/Deckblätter usw. die in einer PDF-Datei hintereinander angefügt wurden. Zudem hat Susman ja schon zugesagt, dass eine Vertraulichkeitserklärung unterschrieben wird. Es sieht also so aus, als würden Susman + EC alles tun, um deren Voraussetzungen für eine HV zu erfüllen, um dann auch darüber verhandeln zu können und auch um an die Dokumente bei WMI zu kommen.

Ich frage mich, was das für eine Strategie ist. Alle mauern und weigern sich irgendetwas offen zu legen. Nur das EC gibt jeder noch so bekloppten Forderung nach...

THJMW delayed (sub judice) her decision on the Summary Judgement for the 4.4 Billion deposits that WMI has in JPM accounts. Weil used the premise of the Global Settlement as their catalyst for delaying and shelving her decision. It is now known that the GS will expire on Aug 30. After that any party to the case has the right to ask THJMW to render her decision on the expensive briefed and argued Summary Judgement. I say we ask her for it..

We act as a group of shareholders who have joined together to request the decision. We ask our EC to ask for the decision or we do so in court letters. We put the bug in the ear of Nelson and Susman, we want that decision, because it potentially along with the IRS refunds (5.2 Billion settled) will put A>L and allow Susman to initiate CRAMDOWN hearings, therefore paying off the creditors and taking their ability to vote on the POR and purchase the new stock in the reorganized WMI. We need to ask for the decision.. Somehow !!! We will also get the Case trustee, because Weil and A&M have breached their fiduciary duty to the estate, along with the current BOD who tried to give it all away for nothing..

Hier steht etwas, das die 100% Tochter von WMB (University Street,Inc) sämtliche Cayman (die dort beschrieben werden) in der Bilanz dieser Tochter stehen und das WMI und WMB nichts damit zu tun haben.

The EC was allowed to intervene in the adversary proceeding. To date they have not joined in the motion for summary judgment on the $4 billion. I would think if the ec was allowed to intervene before the global settlement was signed , that the proceeding is technically not disposed of yet despite a settlement by the fdic/jpm/debtors. Perhaps the por has to be rejected first before the joinder could be filed. There is probably no clear answer in the law as to this. Also, I presume that if they did at this point, it may cause the parties to walk away from the settlement table. In addition, it may be unnecessary because the examiner will draw his own conclusion as to JPM s claim to the $4 billion.

Did anyone notice that Walrath scheduled the Tps declaratory action on the Caymens for trial on November 1st. This action was filed on July 7th and I haven't seen any answers/response filed to the TPS pleading yet either by jpm or the debtors. One should reread that pleading. It contains debtors /jpm's allegations and statements to support Tps arguments that there was no conditional exchange and that the p and a specifically excluded jpm from acquiring wmi assets. I can't wait to see the responses to their own words. It is rather extraordinary to set something for trial before the responsive pleadings have been filed. I wonder what role the examiner will play in this proceeding. I wonder why the tps plaintiffs have not added the wmi directors as they threaten in a footnote. To do so would cause a delay of the hearing. Walrath has basically indicated to rosen that until the tps proceeding is resolved, the por is not going to get a confirmation hearing imho. So jpm and the debtors attempts to delay this trial is going to only delay the confirmation process.

@orakel: was Deine Frage bzgl der Wahrnehmung des Stimmrechts angeht hab ich nichts brauchbares gefunden (zu spät für halboffene Augen), außer einem der meinte das man aus den USA nichts kommt bzgl HV (hab aber keine Erfahrung damit). Theoretisch sollte es doch so sein, das man einen Stellvertreter benennen kann wenn man nicht selber sein Stimmrecht wahrnehmen kann. Und man auch gleichzeitig mit einer Einladung ein Formular diesbezüglich erhält.

Der Witz ist die Beweislast. Da die BAD LOANS UrPlötzlich "VAPORISIERT" wurden da es wieder entgegen der behauptungen der FDIC und OTS ging und doch ein gutes Geschäft war, kann es ja nicht an der blühenden Wirtschaft liegen das die Kredite doch bezahlt werden. Es gab ja keine blühende Wirtschaft. Woher kam das Geld dann?

Nirgendwo her. Genau da wo es vorher auch war. Bei dem Kreditnehmern.

Problem ist wie gesagt die Beweislast. WARUM konnte WaMU denn nicht selbst mit eigenen mitteln diese KURZE Zeit überbrücken um auch feststellen zu können das es keine BAD LOANS sind? (abgesehen davon wissen die das ja das es keine sind)

Wie sollen sie das denn wenn bei Shorting und negativem Presserundumschlag die Kunden die Einlagen abziehen. Also geplant. NUN liegt die BEWEISLAST ja auch bei JP/FDIC/OTS zu beweisen das WAMU das nicht allein gepackt hätte. Geld war ja noch genug da. Die hatten nicht mal so miese Zahlen wie andere die auch noch Tarp bekommen haben.

Wenn nun anhand der Caymans weiter geforscht wird und JP in BEWEISLAST der BADLOANS gehen muss entsteht doch plötzlich stark der DRANG NACH DER BEWEISLAST bei dem der das Ranking gemacht hat. Und der wiederum muss angeben warum er dieses Ranking so ausgeführt hat.

Und wie wir alle WISSEN wird das UNMÖGLICH sein zu plausibel zu begründen.

NENNE mir einen einzigen Grund weshalb WAMU KEINE Staatliche hilfe bekommen hat.

Eventuell wegen dem RATING der FDIC UND OTS? Tja wer ist dann nun Schuld? ;o)

All diese Fragen werden dann nun endlich wieder unter die Lupe genommen werden müssen. Bislang hatte man ja leider keinen Ansatz.

Was schliessen wir daraus?

Mühsam Ernährt sich das Susman Eichhörnchen. Aber das kommt auch noch durch den Winter.

Es scheint nicht nur die Class 19 zu entfallen, sondern auch die Class 21 (Dime Warrants Claims) schwebt noch ungeklärt. Darüber hatte ich mal was zusammengefasst.

Freunde, ich weiss, das Geld sitzt bei uns Deutschen (ich verallgemeinere hier jetzt - sorry, wem das so nicht passt ;-) grundsätzlich nicht sooo locker!

Dennoch bin ich der Meinung man sollte die Leute die in den USA an forderster Front auch für UNS kämpfen soweit wie unterstützen, auch finanziell. Ich glaube es bricht sich niemand einen Zacken aus der Krone, wenn er einen Betrag "X" zur Verfügung stellt.

Der Empfänger ist Michael Willingham.  Wie unter Punkt 10. beschrieben kann man sich auch eine Spendenquittung ausdrucken. Meines Wissens lässt sich die Spende sogar beim Lohnsteuerjahresausgleich absetzen. Alles worauf wartet Ihr?

Denkt mal drüber nach...ich finde es absolut in Ordnung für die Erreichung unseres Zieles auf diese Art einen Beitrag zu leisten!

Leider muß ich gleich zur Arbeit um bei http://www.secinfo.com die Cayman-Serie J,L,M und N zu finden. Ich hoffe da steht auch so etwas wie bei der I-Serie.

Moin,
nun habe auch ich mein kleines Schärflein zur Unterstützung beigetragen.
Ich denke, Kleinvieh macht auch Mist. ;-))
MMn sollte wohl ein jeder der hier investiert ist, ein Intresse daran haben, dass die beiden ihren Kampf fortsetzen und auch beenden können.
Es wäre doch echt Sch**** wenn sie aufgeben müssten, weil ihnen das Geld ausgeht!
Ich hoffe nur, dass unsere Spenden auch wirklich bei den beiden ankommen.

Mit den Spenden ist so immer eine Sache.Die meissten Spenden gehen schon für Verwaltungsaufwand flöten und erreichen den der es wirklich braucht nur schwerlich.Schau Dir Pakistan an.Die meissten Spendengelder,sind schon vorher weg bevor sie in Pakistan eintreffen.

hier liegt die Sache ja schon ein wenig anders und ist mit Spenden nach Pakistan nicht zu vergleichen.

Es geht doch schlicht und ergreifend darum das so viele shareholder wie möglich eine HV ermöglichen und eine Einheit darstellen. Auch mit Hinsicht auf THMW&EX, die diese Aktion mit Sicherheit ebenfalls  verfolgen werden.

Von 3500 angeschriebenen shareholdern nur 171 Spenden. Das ist zu schwach und muss m.E so  richtig knallen, damit die wach werden!!!
