San Francisco - Die Chefs von Apple und Samsung erörtern in letzter Minute, ob sie ihren erbittert geführten Patentstreit beilegen können.

Wenige Tage vor dem erwarteten Urteil im Patenprozess in Kalifornien wollten Apple-Lenker Tim Cook und sein südkoreanischer Kollege Kwon Oh Hyun am Telefon miteinander sprechen, berichtete die Finanznachrichtenagentur Bloomberg am Montag unter Berufung auf eine informierte Person.

In dem gerade laufenden Patentprozess in San Jose hatte Richterin Lucy Koh die Unternehmen zu einem neuen Verhandlungsversuch aufgerufen. Die Zeit für solche Gespräche drängt: Voraussichtlich am Dienstag geht der Fall in die Hand der neun Geschworenen.

Cook und der damalige Samsung-Chef Gee Sung Choi hatten bereits im Mai auf Aufforderung des Gerichts ergebnislos versucht, den Konflikt in zweitägigen Verhandlungen zu lösen. Jetzt, nach dem mehrwöchigen Prozess, ist die Lage jedoch anders. In San Jose sah es nicht danach aus, als wäre es einer der Parteien gelungen, die Geschworenen mit ihren Argumenten eindeutig auf ihre Seite zu ziehen. Zugleich verbrauchte Samsung schneller sein Zeit-Limit von 25 Stunden, so dass Apple zum Schluss die Zeugen fast ohne Unterbrechungen durch die Gegenseite befragen konnte.

Richterin Koh warnte beide Konzerne wiederholt vor dem Risiko, den Streit von den Geschworenen entscheiden zu lassen. «Es ist Zeit für Frieden», hatte sie vergangene Woche erklärt. Zugleich verlor sie zunehmend ihre Geduld mit der Prozessführung beider Seiten. Einen Apple-Anwalt fragte sie, ob er die Droge Crack geraucht habe, weil er kurz vor Schluss noch eine lange Zeugenliste vorlegte. In einem anderen Moment ließ sie die Bemerkung fallen, sie glaube nichts mehr, was ein Anwalt in ihrem Gerichtssaal sage.

Die ersten Gespräche zwischen Samsung und Apple hatte es noch im Jahr 2010 gegeben, im April 2011 reichte Apple die Klage in den USA ein, die zum aktuellen Prozess führte. Samsung konterte mit eigenen Vorwürfen.

Apple wirft Samsung vor, Design und Software von iPhone und iPad kopiert zu haben, und verlangt über 2,5 Milliarden Dollar Schadenersatz. Der südkoreanische Konzern bezichtigt den Rivalen im Gegenzug, unerlaubt technische Patente zu nutzen. Der Streit läuft in mehreren Ländern, darunter auch in Deutschland.

Bei Richterin Koh liegt noch ein neueres Verfahren, in dem Apple das Top-Smartphone Galaxy Nexus angreift. Die Richterin hatte auf Antrag von Apple ein vorläufiges Verkaufsverbot erlassen, Samsung ging dagegen in Berufung. Bei einer Anhörung im Berufungsgericht am Montag bekräftigte Apple den Vorwurf, Samsung habe eine Funktion des iPhone-Assistenten Siri kopiert, um den Absatz zu steigern. Samsung kontert unter anderem, das Galaxy Nexus habe dem iPhone keine nennenswerten Marktanteile abgenommen.

The products at issue in this investigation are consumer electronic devices with wireless capabilities, such as electronic tablets, smartphones, e-readers, mobile hotspots, broadband wireless modems, and handheld game consoles. The investigation is based on a complaint filed by Technology Properties Limited LLC and Phoenix Digital Solutions LLC of Cupertino, CA, and Patriot Scientific Corporation of Carlsbad, CA, on July 24, 2012. The complaint alleges violations of section 337 of the Tariff Act of 1930 in the importation into the United States and sale of certain wireless consumer electronics devices and components thereof that infringe a patent asserted by the complainants. The complainants request that the USITC issue an exclusion order and cease and desist orders. The ALJ will make an initial determination as to whether there is a violation of section 337; that initial determination is subject to review by the Commission. The USITC will make a final determination in the investigation at the earliest practicable time. Within 45 days after institution of the investigation, the USITC will set a target date for completing the investigation. USITC remedial orders in section 337 cases are effective when issued and become final 60 days after issuance unless disapproved for policy reasons by the U.S. Trade Representative within that 60-day period.

Q: How is a Section 337 investigation initiated?      
A: A complaint requesting a Section 337 investigation is filed with the U.S. International Trade Commission (I.T.C.). The I.T.C. is an independent federal agency consisting of six Commissioners appointed by the President and confirmed by the Senate. Once a complaint is filed, the I.T.C. has 30 days to determine whether an investigation should be instituted on the basis of the complaint. Q: How long does it take to complete a Section 337 investigation?          
A: Although the URAA eliminated the strict time limits for Section 337 investigation, the I.T.C. is required by statute to complete Section 337 investigations at the earliest practicable time. To this end, at the outset of each Section 337 investigation, the Administrative Law Judge sets a target date for completion of the investigation. The target date usually calls for completion of the investigation in one year, however, more complex investigations may take about eighteen months to complete. (underline by me)      

Q: Is temporary relief available?          
A: Yes. Following district court preliminary injunction practice, the I.T.C. may issue temporary relief in the form of temporary exclusion orders and/or temporary cease and desist orders. ach ja wird auch genannt, vor falscher "euphorie" warnen mit dem hinweis auf die erfahrungen der vergangenheit.

dass diese auf agora aktive "gang" (aus meiner überzeugung) in der vergangenheit durch, (wie ich sehr stark vermute) manipulation (merry go round) den kurs steuerte, ist dabei doch bemerkenswert. (permanent bod bashing)

aber soviel wie ich weiss soll ja in den us bei der sec in dieser richtung eine antrag auf untersuchung vorliegen.

ob dies was mit den ab und zu hohen stückzahlen und sekundengenauen abwicklungen hier in deutschland zu tun hat..........??? alles nur eine, aber meine, meinung, wie manch hoch geschätzter formulierungskünstler zu bemerken meint.
