Mist, das habe ich übersehen. :(

Damit können sie u.a. im Miningbereich  weiterhin alles blockieren, was  ihnen nicht in den Kram passt. Und Regierungen können wechseln.

Das Schicksal von SouthGobi lässt grüßen.

Bin wieder auf dem Boden gelandet und nehme meine Euphorie wieder ein Stück zurück.

Was bleibt dann noch an Positivem?

1. Die bisher vorgeschriebene staatliche Beteiligung bei strategischen Vorkommen ist wohl weg.

2. Die Gleichstellung ausländischer Investoren mit den Mongolen (siehe jedoch den Passus über die genehmigungspflichtigen Investitionen). Da müsste man sich aber erst einmal den genauen Wortlaut ansehen.

3. Die (wenn auch eingeschränkten) Steuererleichterungen für bestimmte  Investitionen.

Für PCY bleibt es positiv....unser Mining hat das "approving procedure" bereits erfolgreich durchlaufen und Power Plant Projects werden nicht mit aufgeführt.

Anstatt auf deine, von mir belegte Heuchelei einzugehen, lässt du lieber das Posting löschen. Dass du kein Rückrat hast, war mir bisher neu!

Euphorie wohl eher beim Kurs aktuell. FRA bereits über 20% im plus.

Das neuie Gesetz teilt die Unternehmen in zwei Teile
1. von der Regierung als Strategisch eingestuft (ca 20Stück)
und
2. nicht Strategische

Der Hintergrund ist die hohe Einflußnahme einzelner Groß- Projekte auf das GDP. Oyu Tolgio wird ca 30% des Mongolischen GDP erwirtschaften.
Prophecy Coal gehört zu den nicht Strategischen Projekten. Insgesamt ist das neue Gesetz positiv zu sehen. Riesen wie Rio Tinto wird etwas Luft aus den Segeln genommen, was auf dere politischen Ebene durchaus verständlich ist!

Ja, natürlich, ich sehe es auch positiv. Aber ich war wohl ein wenig zu euphorisch. Mir geht es nicht nur direkt um PCY, sondern auch um das gesamte Investitionsklima in der Mongolei. Und die 30%-Regelung beseitigt die entstandene Unsicherheit nicht vollständig. Gerade große Investoren brauchen Planungssicherheit.

Auswirkungen auf PCY?

Mehr Investitionen in der Mongolei bringen mehr Energiebedarf, nicht zuletzt wegen des steigenden Wohlstands und des damit verbundenen höheren Ressourcenverbrauchs.

Na ja, sehr ökologisch argumentiert ist das nicht. Aber wir haben nun einmal in Kohle investiert und das wohl nicht unter ökologischen Gesichtspunkten.

Ich glaube, da irrst du dich.
Beide Vorkommen UO und Chandgana gehören vom Gesetzt her zu den strategischen, nur der Staat hat "seine Option" noch nicht realisiert.

Das wissen sie, und arbeiten dran.

Die bisherig als Strategisch eingestuften Deposites sind Öffentlich! Da gibt es nichts hinein zu interpretieren?

Es "könnten???" weitere auf der Agenda stehen, entschieden ist noch nichts. Der besondere Strategische Anspruch  liegt in der Qualität der Resource und/oder deren Größe. Für beide Kriterien fehlt es Chandgana an den nötigen Daten.
Da das KKW ein PPP mit 20jährigem Übergang an den Staat sein wird, sehe ich keinen Grund für die Ausweisung als Strategisches Projekt. Auch nicht für die Zukunft und auch nicht nach Bauchgefühl!

1. PCY's JV Partner ist 100% SOE ( state owned enterprise).
2. Unter dem alten oder neuen Gesetz  bräuchte Prophecy & JV Partner für mehr als 30% an Chandgana Ltd  "go-ahead" von der Regierung.
3. Energy Sektor ( Chandgana KKW) war und ist nicht betroffen.
4. Da PCY nicht mehr als 30% an Chandgana verkaufen wollte und KKW nicht betroffen hat sich   dem neuen Gesetz  für PCY  nichts geändert.

MMn ist für UO ein anderes Gesetz wichtig, was noch kommen sollte - "revisions to a rivers and forests law", mit entsprechender Klärung des Lizenzstatus.

Allerdings genügen Gesetzesänderungen alleine nicht. Verlässlichkeit und Berechenbarkeit sind   ebenfalls unverzichtbar.  Sowohl in der Konstanz von Gesetzen (wie schaut es nach der nächsten Wahl aus?) als auch in deren Umsetzung.
