Seller short, settlement pending

Hi,

More than a month ago, I bought some GDRs on the Frankfurt Stock Exchange. However, the seller was shorting this GDR (sold it without actually having it) and till today I have not received my shares, apropos the settlement has not been done. Is there a way to force the seller to deliver my GDRs?
