Jan 2021 Lufkin pleads guilty to additional counts of bribery. Feb 2021 the Supreme Court reversed on the ‘Territorial Scope’. In other words companies do not have to produce documentation if outside the UK. Lufkins company was outside the UK. SFO after 4 years were forced to close down the case against KBR as it did not meet the evidential test. KBR & PFC were connected to Unaoil. I believe Lufkin will not be sentenced on June 21 as it is a ‘Mention hearing’ where he will confirm if he is guilty or not.
With the above in mind it is now a possibility that Lufkin will plead not guilty. He could stress that any information given was under duress. IF the courts accept his reasoning, they could then strike out evidence submitted. You cannot be found guilty without evidence. Hence the dropping of the KBR case. If we apply the same principal then Lufkin will not be sentenced, no fine and potential exoneration of PFC.
