Auch mir geht es so, ich lese mir gerne alte Informationen 2-3 durch. Ich bin es leid ständig hier zu blättern, in so fern finde ich ein wiederholtes Posten/Reinstellen als sehr fruchtbar.
Lass dich deswegen nicht aus der Ruhe bringen, du machst das klasse!

kurz nach der HV gelesen, dass die WMI-Holding  "in Kürze" eine eigene Website schalten wollte. Bis jetzt geschah nichts. Aber ohne eigene Homepage ist eine Firma in der heutigen Zeit "nicht existent!"

Nun könnte man sagen: was sollen die denn schreiben.....ohne Geschäftsmodell....??

Ich finde:  Gerade in dieser "Übergangsphase" des Unternehmens suchen viele nach (seriösen) Informationen, um sich ein Bild über den Fortschritt der Entwicklung zu machen. Und das geht über eine Homepage sicherlich besser als mit den "Infos von Sierra...."

Für uns alle wäre es ein Gewinn!

Es rauscht furchtbar und ist nur schwer zu verstehen. Klingt aber im Moment nicht gut, was ich da höre. Wenn ich es richtig verstanden habe, fragte Walrath gerade Rosen, ob er die Claims bezahlen würde, wenn sie die Reserve freigeben würde, den Claims aber später (vollumfänglich) stattgegeben würde. Berechtigte Frage, leider... Habe aber keine Ahnung, warum sie heute schon dieses Thema besprechen...

...die Motion wohl denied wurde. War alles sehr konfus. Die Rolle der FDIC scheint auch allen nicht so ganz klar zu sein. Klingt aber alles nicht nach einer kurzfristigen Lösung. Alles IMHO und ohne Gewähr. Sehr schlechter Ton!

Jetzt plappern sie weiter, weil keiner weiß, wie es jetzt weiter gehen soll. Geht wohl um rd. 6 Mio. (!) Docs, die irgendwie gesichtet werden müssen. Zum Schluss hat sie gesagt, dass man am 24. September 2013 wohl noch einmal dazu "konferieren" will.

Da ich den Anfang nicht mitbekommen habe, weiß ich nicht, ob es sich tatsächlich auf eine Diskussion um die jüngste "Estimation-Motion" handelte, oder sich auf die potenziellen "Golden Parachute"-Settlements bezog. Auf jeden Fall fragte sie Rosen, ob er es denn dann aus seiner Tasche bezahlen würde. Einen trockenen Humor hat sie ja... ;-)

Der Antrag auf die Freisetzung der Reserven und die Schaetzung der verbleibenden Claims hat das nicht betroffen...kannst also weiter auf baldige Teilauszahlung der WAHUq,s hoffen.
Laut dem Doc ist die Einspruchsfrist bis 4 Sept, und am 24 Sept soll ein Hearing darueber stattfinden.

Was noch neben den schon diskutierten Zahlen im Doc steht.

Rosens Plan, ueber Mediator , die Angestelltenclaims schnell vom Tisch zu haben, ist definitiv gescheitert. Rosen spricht von schwer in den Griff zu kriegen, schwerfaellig, langwierig.

Selbst das Eingreifen der FDIC scheint einige Ex Angestellten nicht sonderlich zu beeindrucken. Rosen bringt in diesem Doc zum Ausdruck, das einige Claimants wohl auch bereit sind, den Klageweg zu beschreiten, und das das Jahre dauern koenne .

Fuer die " es gibt erst News , wenn alle claims abgearbeitet sind " Theorie eigentlich nicht gut, denn

a: es gab vor kurzem ein Doc, in dem Mary es einigen Claimants erlaubt hat, Ihre Claims unter Umstaenden modifizieren zu duerfen.

b: bei ein paar Claimants steht bei Ihren Anspruechen plus Anwaltskosten.

c: die Kosten fuers Estate laufen weiter, die Kosten fuer die Mediation waren fuern Bobbes.

d: es werden schon jetzt Fristen bis Ende Januar betreff einiger Claims eingeraeumt.

Ohne die Freisetzung irgendwelcher Reserven werden die WAHUQ,s nicht in gaenze ausbezahlt werden.
Man braeuchte dann schon zumindest Kohle aus der D und O Geschichte, und wie schnell es da weitergeht, weiss man auch nicht, wobei es ja scheint, das die "neue Mary " ein wenig energischer ist als die alte .

Dann kann erst der Marta Claim wiederkommen. (Glaub Ich zwar nicht, aber wissen tu Ich es nicht). Aber falls, wird auch der wieder Zeit kosten.

Ausserdem ist der Claims ja eh schon definiert  435 Millionen.

Ich will die "erst claims abarbeiten...dann News " Theorie ja nicht vollkommen ausschliessen, aber das koennte noch Jahre dauern...und ganz schluessig erscheint Sie mir auch nicht.

BTW ~ Spence's argument that these claims were made years ago and wasn't addressed is just a lot of hot air argument.   Everyone knows the battle that went on by Equity against the Debtor/Creditor/SNHs that even put enough money into the Trust to pay anything to anyone below the bondholders.    Now they arrogantly argue that Rosen/WGM/LT didn't address them earlier!!    

It thoroughly pisses me off because there wouldn't be an extra dime in that Trust if not for the efforts of the equity holders and now these attorneys create this 'so harmed' drama!!!   BS!!

If someone else has a chance to listen to the hearing, please see what you understand about what JMW is wanting from the FDIC.   My understanding is that she instructed Rosen to make the filing for a declaratory action/judgement.    Rosen didn't feel he should do it because he agrees with the FDIC that they have a regulation in place on "golden parachute" payments and that the regulations should be followed thereby allowing the FDIC to intervene and approve/disallow a claim.    He felt those that did NOT want the FDIC involved should make the filing against the FDIC.   We will see how he does it but my guess is the FDIC is going to say "we've already given you our opinion and it stands."   If they have to make a legal declaration to the Court, then I believe it will be the same as what the stated in their letter.

Charlie, yes, IMHO, the overriding factor is the FDIC. Since Rosie agrees with the FDIC, then it appears this could be over rather quickly. Very simple, if the FDIC deems these all balloon payments of one sort or the other to which Rosie agrees and they put this in writing, then this should be all about over.

Rosie wants to keep billing and dragging this out which he knows if the FDIC makes this filing of no payments due to balloon payments, then not only do the already made settlements become invalid, but all the rest of the similar claims ending this part rather quickly. I cannot imagine the FDIC recanting on these 'are' balloon payments now. This could put even more money toward the end result as well.

From what I've read here it seems as though Rosen has the answer he needs / wanted from the FDIC, they were / are wanting the complete correspondence between Rosen  / FDIC which Rosen baulked on ( why add more? ), nothing to be gained by mucking around with FDIC except to make them mad so if they want it, how about you just go get it.

This is a "tar baby" issue the harder you hit it the stucker you get.

Oha, wenn ich Deinen Text so lese, kommt bestimmt bald unser fasterlein um die Ecke und schlussfolgert messerscharf, dass Du jetzt "auch" ein "Goldman-Schreiberling" bist, lol... ;-)

Zu Marys Aussage: Ich bin mir nicht sicher, worauf sich das bezog, da ich zu spät eingeschaltet habe. Sicher ist, dass sie Rosen die Frage gestellt hat und er später geantwortet hat, dass das ja ohnehin erst Sache des nächsten Hearings wäre. Was er bzw. Mary damit meinten, ist mir nicht ganz klar. Vielleicht ging es ja auch darum, dass sie kein Settlement abnicken könne, wenn die FDIC nachher sagen würde, es dürfe nichts gezahlt werden. Wäre gut, falls jemand einen Link zu der Audio-Aufzeichnung hätte (falls es eine gibt). Unfassbar ist für mich die Tatsache, dass allgemeine Verwirrung über die Rolle der FDIC herrschte. Als positiv für uns habe ich herausgehört - zumindest bilde ich mir das ein -, dass die Anwälte der Claimants auf jeden Fall vermeiden wollen, doppelte Klagen zu führen (wohl gegen Trust und FDIC). Califano (ich denke, er war es), wollte sich aber auch nicht festlegen. Das Thema FDIC muss auf jeden Fall erst einmal geklärt sein, vorher wird Mary nichts absegnen, das erscheint mir sicher. IMHO.

alle wollen was vom kuchen haben.. ist doch klar... anwälte... ex Mitarbeiter.. und.. und..

das dumme ist nur das wir die letzten sein werden die an den Napf kommen.. ob dann noch was zu holen ist... fragen über fragen..
