Federal Judge Dismisses Biolase Lawsuit Against Fotona

SAN CLEMENTE, Calif. and LJUBLJANA, Slovenia, June 11, 2014 /PRNewswire/ -- The Fotona companies, (Fotona), announced today, that on June 2, 2014, the federal judge in Orange County, California has dismissed all claims of Biolase's (BIOL) lawsuit against Fotona d.d. and Fotona LLC. Among other things, Biolase had challenged Fotona's statements that its lasers were faster for hard tissue dental applications than Biolase's lasers. The Court concluded that Biolase has failed to state a claim for false advertising since Fotona's advertising statements are accurate restatements of conclusions in scientific journal articles. Fotona will continue to vigorously defend its products, and take action against false or misleading claims.
