... dass Lehman denen ganzen Originators oder Erzeugern falscher Hypotheken-Verbriefungen offenbar ab sofort noch ein wenig stärker auf ihren Zahn fühlt...

Das dürfte ein paar Gelder in die Lehman-Cassen spülen, und zwar als Ersatz für jene Schäden, die diese Unterjubler von Defective Loans dem Lehman-Vermögen in der Vergangenheit angetan haben.

...und noch ein Kommentar zu dem Settlement Disput zwischen Lehman und JPM von edbk46 aus dem Google Gruppe, da soll es ja bis zum 29.02 eine Einigung zwischen den beiden geben:

this 8.6 b is pre bk money
jpm took this in margin calls before bankruptcy was declared
Lehman has been saying that the margin or good-faith money was over and above what should of been used
Chase has been saying they need this money to protect their affiliates

The settlement that was approved by the bankruptcy court  does not protect chases customers
This is where the argument is was the CTs and affiliate trust of chase or where the CT holders just customers

imho I think the CT trust was an affiliate of chase.
The individual holders of CT shares are not able to change trustee
the trust was changed to Bank of New York Mellon there was no need of approval from any CT holder
the CTs since they were under trust that was not part of Lehman could not be placed in the OBS
and technically are not in bankruptcy

This  in my opinion makes us an affiliate, a customer can change banks at whim
Now what cotton is saying again imho is that Chase guarantee  the CTs
therefore when they were calling for more margin for their affiliates
they should have called for margin for the CTs this is the fiduciary duty that was breached
The agreement by Chase and Lehman has not addressed this issue leaving it for another day
this is why cotton objected


So we wait Judge Sullivan orders on whether he will agree to a partial settlement
or put more pressure on to settle the CT issue
I think these are under the CDA's
Bank of New York Mellon has placed all of the 10 B class claims
this is why they have asked the court for fiduciary fees
