Das Hearing, auf dem das ausgehandelte Settlement Agreement gerichtlicherseits erst noch approved werden muss, ist für den FEB/08/2016 vorgesehen, also genau einen Tag, bevor dann hier bei uns auf Ariva endlich das "Tippspiel DFB-Pokal, Saison 2015/16, Runde 4 Viertelfinale" in die active Ausspielung geht.

Das Geld landet Cash bei Lehman und solange es nicht an Gläubiger weitergereicht wird oder wenn es gar nicht weitergereicht wird könnte es Lbhi als Bank Hebeln mit Faktor ca 50. 70 mrd. Als gläubiger würd ich auf meinen Anteil verzichten und lieber eine newco basteln mit leverage 70 mrd und Nols 50 mrd

Da hat es offenbar erheblichen Krach in der anwaltlichen Vertretung dieses Claimant's gegeben, so dass derselbe sich gezwungen sehen hat, den von ihm erwünschten Wechsel der ihn vertreten sollenden Societät eigens in eine Motion zu kleiden, wofür unter normalen Verhältnissen eine einfache Mitteilung des Anwalts-Wechsels ausgereicht hätte...

... vorliegende Fall eher wie ein Gläubiger-Wechsel aussehen will, der noch dazu erzwungen wurde, oder: zumindest hat erzwungen werden sollen...

Und ebenso holprig wie diese Erzwingung als solche ist auch das dem Gericht diesen Vorgang mitteilende "Englisch", wobei das diese Kundgabe (vorläufig) abschließende "Further Affiant sayeth Naught" plötzlich wieder gutes, offenbar eher formelhaft auswendig gelerntes, American English ist, unter welchem aber derzeit noch ein paar Unterschriften zu fehlen scheinen.
