Gropper gibt zu, dass dieser ausgearbeitete Vorschlag nicht öffentlich war, und auch nie veröffentlicht wurde. Gropper sagt aber dass er auch nicht wüsste, wo das Interesse der Öffentlichkeit an einem bloßen Vorschlag liege.

Sie gehen jetzt nochmal den Vorschlag durch, Gropper macht wieder dieselben Angaben dazu wie vorher bei seinem Anwalt.

Aurelius Capital Denies WaMu Insider-Trading Allegations

July 18 (Bloomberg) -- Aurelius Capital Management LP denied using confidential information to profit on the debt of bankrupt Washington Mutual Inc., saying it installed a soundproof office to prevent traders from hearing sensitive negotiations.

The hedge fund’s managing director, Dan Gropper, testified today in U.S. Bankruptcy Court in Wilmington, Delaware, that he took phone calls in an office 30 feet away from the trading desk while negotiating with WaMu and later spent $150,000 to soundproof his office.

“We are absolutely compulsive about this compliance,” Gropper said, referring to restrictions on insider trading in general.

Shareholders want U.S. Bankruptcy Judge Mary Walrath to reject for the second time WaMu’s reorganization plan, which Aurelius helped negotiate with three other hedge funds. Shareholders would get nothing under the plan. They claim Aurelius and the other hedge funds used confidential information obtained while they negotiated with WaMu to pick the most profitable WaMu securities to buy and sell.

The former owner of the biggest U.S. bank to fail, WaMu is seeking Walrath’s approval for the reorganization plan that would pay creditors more than $7 billion.

WaMu, based in Seattle, filed for bankruptcy on Sept. 26, 2008, the day after its banking unit was taken over by regulators and sold to JPMorgan Chase & Co. for $1.9 billion. WaMu’s Washington Mutual Bank was the biggest bank to fail in U.S. history, with more than 2,200 branches and $188 billion in deposits.

The case is In re Washington Mutual Inc., 08-12229, U.S. Bankruptcy Court, District of Delaware (Wilmington).

The company has been in bankruptcy, and creditors have been awaiting repayment, since September 2008, when its savings and loan was seized by regulators in the biggest bank failure in U.S. history.

The seized bank was sold to JPMorgan Chase & Co (JPM.N) for $1.9 billion.

Monday's hearings began with Gropper being questioned by his attorney about the fund's operations and how it separated trading activity from his role at the negotiating table.

In addition to spending $150,000 sound-proofing his office, Gropper said it was agreed that Washington Mutual would decide what constituted material nonpublic information which must not be used for trading.

This is the company's second attempt to end its bankruptcy. In January, U.S. Bankruptcy Judge Mary Walrath in Delaware rejected their last plan, in part because an individual investor accused four hedge funds of insider trading.

Since the last plan was rejected, the official committee of shareholders has been investigating the funds, which also include Owl Creek Asset Management LP, Appaloosa Management LP and Centerbridge Partners LP.

Unlike recent high-profile government probes of hedge-fund managers and insider trading, the funds in this case do not face criminal penalties.

The judge could penalize the funds by cutting the amount of interest they can collect on their Washington Mutual debt, or she could even reject the reorganization plan if she finds it was not negotiated in good faith.

Gropper sagt wieder, dass er keinen Zweifel hatte, dass das 4-Milliarden-deposit letztlich bei WMI landen würde. Ansonsten wäre die Antwort aber Lichtjahre vom Vorschlag von WMI entfernt gewesen. Folse fragt, ob die Öffentlichkeit bzw. der Markt nicht ein Interesse daran gehabt hätten, dass JPM das deposit freiwillig aufgeben würde. Gropper bemerkt, dass das ja nur so gewesen wäre, wenn WMI gleichzeitig alle fraudulent conveyence claims, die Gropper aus seiner Erfahrung heraus für settlementfähig hielt, und die Steuerrückzahlungen aufgeben würde.

Folse kommt zu dem zweiten Vorschlag von WMI vom 27.4.2009. Folse bringt eine entsprechende Email von Rosen. Gropper behauptet, diese Email erstmals bei seiner deposition gesehen zu haben. Hier hat WMI laut Folse die deposits sowie einen 50/50 split für den ersten Teil der Steuerrückzahlungen und 80/20 für den zweiten vorgeschlagen. Gropper liest es und bestreitet diese Feststellung. Daraufhin objection, und Folse zieht seine Frage zurück.

Am nächsten tag wäre er mit Kosturas am nächsten tag und erzählte was man von den debotrs weiss Stimmt das? Kann mich nicht erinneren, ich habe ihn im April angerufen, er wüsste auch nichts von dem Anruf von Rosen und Aurelius Anwalt
