Nun sind wir ja wieder bei dem Kurs angelangt den ich vor 2 Wochen vermutet habe und von den usern orleon und daschauher angepisst wurde.

This is ambiguous because it says "all Assets of the Debtors" "except (i), (ii), (iii), and (iv)" which includes Cash and WMI Investment but then says in (iv) that "for the avoidance of doubt, shall be contributed to the Liquidating Trust, including any Intercompany Claims"

Well is it in the Liquidating trust or is isn't it???

I've been studying the POR for several days now preparing a summary, and this part tripped me up, too, for a bit... My understanding of this section is that there will be two entities making distributions - the Debtors themselves, and the Liquidating Trust.

The idea here is that the Debtors will distribute cash (since there's nothing to liquidate) and all other assets go to the Liquidating Trust for liquidation and distribution by the Trustee.

Nothing nefarious about it - all assets which are not cash will be transferred to the Trustee for liquidation. Everything will be distributed.

Wenn jede Stunde welche man am PC sitzt mit 1000 $ und mehr vergütet werden, dann braucht sich niemand zu wundern, dass dabei so etwas herauskommt.

Ich bin sicher kein Freund von Rosen jedoch ist dieser "sicher" nicht Dumm. Er nimmt mit was geht und dies ist nicht nur bei Anwälten so, sondern überall auf der Welt und bei fast jedem.

Rosen wird noch eine wichtige Rolle spielen dessen bin ich mir sicher. Ich bin mir auch sicher, dass dieser letztendlich dort arbeitet wo es etwas zu holen gibt wie alle.  Rosen vertritt eine Partei und ist somit der Ansprechpartner für die andere Partei. Diese Leute haben ein Gespür von wo der wind her weht. Er wird wenn es soweit ist, seiner Partei  den Deal  genauso verkaufen wie er bisher uns versucht dies zu verkaufen. Leute wie er schwimmen immer auf der Suppe und niemals am Boden der Suppe.

Wir können dies doch schienbar gelassen beobachten (wie im Kino) den Eintritt haben wir schon bezahlt. Bleiben wir doch einfach bis zum Ende der Vorführung, denn etwas anderes ist es nicht. Es werden "alle" Parteien sich gemeinsam auf dem Schlussfoto die Hand schütteln und sich feiern lassen. Wir machen dies halt am Bodensee.

Bin schon gespannt wer hinter all den Forums Namen steht und ob VD auch kommt.
