FROM ILENE: Received a text from Ilene to post something for her...I told her yes! She sent me a follow up text asking if she could call. Below is what Ilene reported to me over the phone...
Quote:
I called and spoke with Judge Walrath's Clerk (his name is Brandon. Before getting to Brandon, I spoke with 3 or 4 people who all asked if I was a reporter (I thought this was interesting). Brandon told me what goes on in the Judges Chambers is never on record. So the transcript being referenced is the 1.5 minute exchange from the hearing. The transcripts from the hearings are always sealed and takes 3 months for them to be unsealed.I asked why they had the filing if it was for only 1.5 minutes. Brandon said that the filing was not anything unusual. I asked again, why the filing? I don't recall there ever being a filing saying the transcripts from the hearing are sealed. Brandon said it was standard procedure. Brandon also said that there is no court reporter and nothing is ever released from Judges chambers.
The big question Ilene and I both had was if this was standard operating procedure, than why was there a filing this time and not the other times. Neither Ilene nor I recall their ever being such a filing. Most importantly sealing 1.5 minutes of a hearing is a bit weird...but nevertheless this is what was reported.
So the only way of knowing what went down int he Judges Chambers was to had been in there or find out from a party that was in that two hour meeting. So looks like we will never know!
Does anyone else recall there being a filing to seal the hearing transcripts for three months?!

Lebosco, there is a standing process (I believe it's a Delaware court general rule) that transcripts are provided for the Attorneys only for a period of time (I think it's 3 months) so that any redactions for confidentiality, etc can be made.
Now of course, that's kinda stupid because there is audio.
But it's the process. In case someone said an account number, name of a minor child, a social security number, etc, etc...
