Das ist die Beantragung des "Projekts Fillmore" durch Peter Freilinger. Danach sollten in zwei Raten 20 Mrd. von WMBfsb zu Wamu transferiert werden. Jedoch kam es dazu nie, da vorher JPM und die Fdic zugeschlagen haben.

Derzeit führe ich einen Internet-Rechtsstreit gegen einen nicht gerade kleinen Verlag aus Bayern. Die Internet-Rechtsgrundlagen sind sehr schwammig formuliert und dadurch der Ausgang im Vorfeld schwer einzuschätzen. Grundlage der aktuellen Rechtssprechung sind das Urheberrecht, Wettbewerbsrecht und die Nutzungsrechtsbestimmungen. Mein Rechtsbeistand ist der Auffassung, dass privat veröffentlichte Interessen nicht strafbar sind. Nachweislich kommerzielle Veröffentlichungen, welche einen geschäftlichen Hintergrund vermuten lassen oder haben, verstoßen wiederum u.U. gegen ein Wettbewerbsrecht (first come, first served). An dieser Stelle sollte man sich dann die zu akzeptierenden Nutzungsrechte genauer anschauen.

Ich hoffe, dass ich etwas Licht ins Dunkel bringen konnte: als Privatperson kann dir niemand ans Bein pinkeln - es sei denn, die Nutzungsbedingungen verbieten dir deine Empfehlungen bzw. deine Meinung zu publizieren.

Das war meine komprimierte Version zum aktuellen Internetrecht. Da ich auch ziemlich OT-sensibel bin, hoffe ich niemanden mit diesem Beitrag zu nerven...

writ of prohibition is a writ directing a subordinate to stop doing something that they may not do, according to law, but are doing. In practice, the Court directs the Clerk to issue the Writ, and directs the Sheriff to serve it on the subordinate, and the Clerk prepares the Writ and gives it to the Sheriff, who serves it. This writ is normally issued by a superior court to the lower court asking it not to proceed with a case which does not fall under its jurisdiction.

These Writs are issued as "alternative" or "peremptory." An alternative Writ directs the recipient to immediately act, or desist, and "Show Cause" why the directive should not be made permanent. A "writ of prohibition", in the United States, is an official legal document drafted and issued by a supreme court, superior court or an appeals court to a judge presiding over a suit in an inferior court. The writ of prohibition mandates the inferior court to cease any action over the case because it may not fall within that inferior court's jurisdiction. The document is also issued at times when it is deemed that an inferior court is acting outside the normal rules and procedures in the examination of a case. In another instance, the document is issued at times when an inferior court is deemed headed towards defeating a legal right.

Writs of prohibition are similar to writs of certiorari, as both types of writs allow superior courts to manage inferior courts. However, unlike a writ of prohibition, superior courts issue writs of certiorari to review decisions which inferior courts have already made.

It is not clear why they did not use their discretionary power to support the one of the largest banks in the country, at least on a temporary basis. The bank had access to $54 Billion of liquidity at that time--$4 Billion was on deposit at Washington Mutual Bank and another $50 Billion was available, assumedly from the secondary window at the Federal Reserve in San Francisco.
