The testimony will concern Blackstone's valuation analysis with respect to each of (i) WMI, as reoganized ("Reorganized WMI"), (ii) Reorganized WMI's net operating losses, as of December 22, 2010, and (iii) Subscription Rights.
James Carreon
The testimony will concern certain federal tax issues related to the Global Settlement Agreement, including Tax Refunds, and the resolution of the disputed ownership thereof.
Jonathan Goulding
The testimony will concern (i) WMI's ownership of certain assets, (ii) the Debtors' decision to transfer and/or retain ownership of such assets under the Global Settlement Agreement and Plan, (iii) the liquidation and feasibility analyses performed by the Debtors, and (iv) the projections set forth in the Disclosure Statement.
Charles E. Smith
The testimony will concern (i) the Conditional Exchange of the Trust Preferred Securities, and (ii) the Debtors' decision to transfer and/or retain assets and liabilities under the Global Settlement Agreement and the Plan, including with respect to the Tower Insurance policies.
Peter Freilinger
The testimony will concern issues related to Trust Preferred Securities, including limitation, the Conditional Exchange, the Downstream Undertaking, and the underwriting, offering and/or issuance of the Trust Preferred Securities.
Steven Simms
The testimony will concern (i) the analysis by the Creditors' Committee regarding the assets and liabilities of the Debtors, (ii) the litigations involving the Debtors, (iii) the claims made against the Debtors, (iv) the negotiation of the Global Settlement Agreement, and (v) the conclusions of the Creditors' Committee regarding the reasonabless of the Global Settlement Agreement and the Creditor's Committee's support of the Plan.
David Sharp The testimony will concern the solicitation process, with respect to the voting by creditors or equity interest holders holding securities, the tabulation of votes on the Plan from such persons or entities, the tabulation of elections regarding releases and forms of distributions from such persons or entities, and the tabulation of Rights Offering elections.
Robert Klamser The testimony will concern the solicitation process with respect to all other creditors and equity interest holders, the tabulation of votes on the Plan from such persons or entities, and the tabulation of elections regarding releases and forms of distributions from such persons or entities.
