This hearing had a very different feel to it. I saw Joseph McMahon walking past the library and knew I wouldn't see him in court. A half hour before the start, we had only ten people in the courtroom. By the time we started, the room was only 2/3 full with some open spots in front. There were only five boxes of documents and not the usual fifteen marked "POR" or "DS". And no water for the I-hubbers.

The WGM attorney who argued for deposing the ec members never got any traction. He had nothing to work with. When Edgar Sargent was speaking for the ec, Rosen was making faces and mouthing "what?". When Sargent brought up Johns Manville, Rosen crossed his arms and finally looked away until Sargent finished. You could see how eager the judge was to shoot down the debtor's ridiculous arguments.
You heard on the call the way Rosen tried to have Mr. Hird go first on the TPS matter, but Mr. Stoll (Brown Rudnick) insisted and was allowed to go first. Around 3:00 PM, Mr. Hird come up to rebut something about metadata. The judge says, "Briefly." She lets him talk, but she is looking at a book and doing some research on the computer.
Mr. Stoll said something about the way JPM should organize the documents they provide and Rosen started making faces again. JPM really ought to hire Rosen outright.
I was surprised Califano wasn't there. His stand-in was a much friendlier-looking guy than Califano, but who isn't?
I don't know if the new person from the U.S. Trustee's office was there or not, but she wasn't at the table where McMahon used to sit.
I had to get out of there to make a train and a plane, but when I hurried out, I saw no laptops in the back row. I did not see Peg Brickley. Therefore, it is possible she wasn't there. That would explain her comment that the damage was done to the bank and not WMI. It's harder to pass her any spin in court, and I think she writes from the back row as the hearing goes on. If she wasn't there it would make sense that she would make a call or two for some color.
Some of this is from my notes. I believe it is all accurate, but there is nothing earthshaking here. Everyone is waiting for the examiner. I was disappointed how few shareholders were there--maybe eight. Two left halfway through. Feel free to re-post because we don't have the grapevine the lawyers have.
