The FOIA permits a person to request access to Federal agency records. Agency records are records located at and under the control of an agency at the time of a request's receipt. To the extent that your request seeks records of Washington Mutual, Inc., those records are not located at or under the control of the FDIC and, therefore, are not agency records subject to the FOIA. Similarly, Washington Mutual Bank's mortgage records were transferred to JP Morgan Chase Bank, N.A. under the Purchase and Assumption Agreement, dated September 25, 2008, and are not agency records.

To the extent that your request may seek any agency records, the FDIC has completed its records search and has not located any responsive agency records.
Because the FDIC was unable to locate any responsive agency records, the FDIC has not made any final disclosure determinations. However, I note that your request was not accompanied by any authorizations for the disclosure of information to you from any of the persons about whom your request seeks information. Therefore, even if the FDIC could locate responsive agency records, by its very nature, such information likely would be exempt from disclosure categorically under FOIA Exemption 4, 5 U.S.C. § 552 (b)(4);1 to the extent that such information pertained to an individual, such information also likely would be exempt from disclosure categorically under FOIA Exemption 6, 5 U.S.C. § 552 (b)(6).2
