The post heading reflects my own conclusion made after a VERY large amount of DD into the 'random pick vs shopped' element. You'll never get the truth out of such a tight-knit bunch of legals in this exclusive & lucrative club they have made for themselves (anyway). They WILL defend THEIR home turf advantages.
Some time back (2 or 3 weeks now) I mentioned I would offer something in a separate post. Well, my recent days haven't left me much board time. (Still reading; not posting). I wanted to offer a number of pieces but, with *THE* hearing coming up tomorrow (7/13), I decided to just cut to it.
I do this by offering a little gem of a piece I came across quite accidentally/tangentially. Never seen it on the boards. It emanates its own insight & solidity on the exact subject of the Delaware Bankruptcy rodeo.
I have a bunch of references & snippets but decided to pull this 'one' out. The reason I did the research in the first place was that, even though I knew nada about BK prior to this, something has ALWAYS been elusive about THIS
whole "arrangement", leaving me consistently uneasy & guarded.
On a side note- for ME, the breaking point was NOT 3/12/10(GSA) but the JMW 1/7/11(Opinion). It's what prompted my outrage in this letter to the court:
