Perjury trap was planted! Delay or deal by 1200 midnight eastern on 7/1/2011

Most people read today entirely wrong as things did not happen that MOST wanted to see. Drama, handcuffs and more would have been nice but not reality in this court. Like a magician, do not look at what the magician wants you to look at because the magician is creating a diversion. Look at what our side did or did not do and focus on the results of today. There is no way Susman was/is going to show a vital card (s) during an Omnibus leading up to the important dates. Keep in mind I did not think May 13th (Susman’s original objections due)would happen and I do not think the criminals will let Susman show his objections on 7/1 without either a delay or some kind of deal. These criminals have spent three years covering, hiding, corrupting, slandering and libeling to keep this out of ALL WORLD news outlets. They have even had the reporting at each important hearing slanted much to the criminals side. These are important actions to not lose sight of. We will continue to see posturing by both sides.

So for today, many people think nothing happened and they think either Susman is incompetent, lazy or worse, paid off. I have NEVER sensed this with Susman as I did with the examiner and have NEVER sensed he did NOT have a plan. With most successes in life, timing and execution play very important roles and the same applies as to why Susman did not have certain players on board until it was time. He did not want to show any more than one has to. I feel the main event today was to get all of the Horsies on board for perjury and that was accomplished multiple times. I still say insider trading is easy to prove and contrary to what most will have you believe. With discovery approved for Susman, all he needed was dates, times, trades and where were you when?

I have no doubts he has this and now if we make it to the Confirmation hearing without Equity (I say no way), all Susman has to show is some of this evidence and yes folks he does have it. That would mean perjury on top of insider trading which would solidify Walrath NOT being able to approve the POR. Keep in mind, by Susman making this move today and playing dumb as a fox; he may have forced the criminals into committing another crime called perjury. If you do not believe this or believe he has sold us out, then you should have sold a long time ago and/or should do so now. Something very, very large is in the making and for one I have no doubt it is my brokerage account, so never mind the magicians as the real tricks have been quietly executed and are in place.

Schönes WE Auch allen.

Ex-WaMu Execs Rotella, Schneider Seek Dismissal Of FDIC

Ex-WaMu Execs Rotella, Schneider Seek Dismissal Of FDIC Suit 07/01 04:02 PM

--------------------------------------------------

(Updates with filing to dismiss separate FDIC suit against executives in paragraph 5, and 18-23.)

--Settlement includes underwriters and auditor paying parts

--Washington Mutual (WAMUQ:$0.1280,$-0.0015,-1.16%) , executives, responsible for $105 million of total amount, to be paid by insurance

--In a separate FDIC suit, two former executives seek dismissal of "pure public relations stunt"

By David Benoit

Of DOW JONES NEWSWIRES

NEW YORK (Dow Jones)--Washington Mutual Inc. (WAMUQ:$0.1280,$-0.0015,-1.16%) and other co-defendants agreed to settle a consolidated shareholder class-action lawsuit for $208.5 million, putting behind it one chunk of the failed bank's litigation issues.

The suit in federal court in Seattle was the consolidated version of several other class action lawsuits filed by shareholders, in multiple courts, that all essentially alleged that Washington Mutual (WAMUQ:$0.1280,$-0.0015,-1.16%) failed to stop them from investing when the now-failed thrift knew, or should have known, how much trouble it was in.

Some of the lawsuits were actually filed long before the thrift's collapse, though the plaintiffs regularly updated the consolidated case to include the latest reports on Washington Mutual (WAMUQ:$0.1280,$-0.0015,-1.16%) .

In a separate matter, two former Washington Mutual executives filed Friday seeking dismissal of a Federal Deposit Insurance Corp. suit from earlier this year. The FDIC just last month had said in a legal filing in federal court that it was in mediation to settle that dispute as well.

Washington Mutual (WAMUQ:$0.1280,$-0.0015,-1.16%) collapsed in September 2008, the largest U.S. bank failure in history. Most of its assets were purchased by J.P. Morgan Chase & Co. (JPM).

On top of the class-action securities suit, there are several other lawsuits across the country over Washington Mutual's (WAMUQ:$0.1280,$-0.0015,-1.16%) actions and subsequent failure.

"There are other cases pending, but this ends the consolidated securities class action, assuming that the settlement receives final approval from the district court and goes effective," said Michael J. Etkin of Lowenstein Sandler PC, a lawyer for the shareholders. "We believe taking everything into consideration that it is a satisfactory figure."

The Seattle plaintiffs, which had alleged they lost hundreds of millions of dollars by buying into the common stock and taking part in various offerings from Washington Mutual (WAMUQ:$0.1280,$-0.0015,-1.16%) , alleged it and its executives made false and misleading statements to keep investors engaged.

The suit also named as defendants executives and directors of Washington Mutual (WAMUQ:$0.1280,$-0.0015,-1.16%) , the various investment banks that acted as middle-men in selling the shares to the investors, and its auditor Deloitte & Touche LLP.

An amended complaint filed in early 2009 said Washington Mutual (WAMUQ:$0.1280,$-0.0015,-1.16%) "was seriously mismanaged and faced seriously deteriorating financial circumstances that rendered WaMu stock an unduly risky and inappropriate investment option for participants' retirement savings."

The Washington Mutual (WAMUQ:$0.1280,$-0.0015,-1.16%) executives--including former Chief Executive Kerry Killinger--had, in their own various court filings, denied the claims.

According to the settlement document, $105 million of the total amount is to be paid by Washington Mutual (WAMUQ:$0.1280,$-0.0015,-1.16%) and the individual defendants named, an amount covered by insurance. The 14 underwriting banks will pay $85 million. Deloitte & Touche will pay $18.5 million.

The settlement will still need a judge's approval.

Representatives for Washington Mutual (WAMUQ:$0.1280,$-0.0015,-1.16%) , Killinger and Deloitte were not immediately available for comment Friday.

Thursday, the Ontario Teachers' Pension Plan Board, the lead plaintiff in the Seattle suit, requested the judge in the case approve the settlement, which it called "an excellent result."

In the suit against the executives, the FDIC accused Killinger, former President and Chief Operating Officer Stephen Rotella and fomer home-loans president David Schneider of reckless lending gambles that sparked the thrift's collapse. The executives, along with the wives of Killinger and Rotella, were also accused of illegally seeking to shield cash and houses from legal claims.

Friday, both Rotellas and Schneider filed to ask the judge to throw out the case in harshly worded filings that accused the FDIC of trying to deflect criticism.

"This lawsuit amounts to a pure public relations stunt designed to deflect criticism away from the FDIC, which has been--and continues to be--under fire for its regulatory failures with respect to WaMu and refuses to take any responsibility for its central role in the financial crisis," the former executives said in their filing.

The executives go on to allege the FDIC's claims attempt to apply what is known today in hindsight, while at the same time ignoring its own actions.

Esther Rotella in a separate filing argued the FDIC has no jurisdiction over her and lacks "any substantive basis" for the claims against her.

An FDIC spokesman declined to comment.
