Aqua Metals, based in Alameda, California, was purportedly formed to engage in the business of lead recycling through a novel process called "AquaRefining." 

The lawsuit alleges that Defendants issued materially false and/or misleading statements and/or failed to disclose that: (a) the Company was touting the business value of the Interstate Battery Partnership and the JCI Partnership; (b) the Company was aware of and ignoring material unresolved deficiencies in the AquaRefining technology and process which were preventing large scale development; (c) the Company was experiencing numerous execution and operational issues preventing scaling and production ramp up at its AquaRefining facility; and (d) the Company was unable to produce and generate revenue from its core business, therefore remaining unprofitable.

As the truth about the Company's AquaRefining process came out gradually, the stock price suffered significantly.  In total, the price of Aqua Metals common stock plummeted more than 77%, from its close price of $16.65 on May 9, 2017, after which the Company announced its first quarter 2017 financial results, to its close price of $3.79 on November 9, 2017.
