bevor ich bei walrat ein "good" (siehe kommentar von fish) vorne hinsetze, müssen noch einige dollarmilliarden fliessen, und zwar in aktionärsrichtung.

aber eine echte bewertung ihrer assets durch wmi wäre mal ein anfang, da könnte man (solomon oder aktionäre) dann relativ leicht einhacken, wenn diese wi zu erwarten falsch ist.

ich befürchte nur, dass das der anfang vom ende ist, ein völliger freispruch für die gauner von jpm und fdic, während die werte, die wmi momentan hat, auf die aktionäre aufgeteilt werden.

das könnte, falls es mit rechten dingen zugeht, durchaus bis zu den stammaktionären durchgehen, allerdings nicht in dem aussmass, wie wenn jpm für ihr verbrechen bezahlen hätten müssen.

Washington Mutual OK To Seek Votes On Revised Chapter 11 Plan 03/21 02:20 PM



WILMINGTON, Del. (Dow Jones)--Washington Mutual Inc. (WAMUQ:$0.0480,$0.0040,9.09%) Monday won court approval to move to the next stage in its renewed attempt to exit bankruptcy, but was told to spell out what effect suspicions of insider trading could have on the $7 billion distribution plan.

Judge Mary Walrath said the company, the former parent of Washington Mutual Bank, or WaMu, can send out its revised plan to creditors for a vote after supplementing it with an analysis of what could happen if there is proof of insider trading.
Estimates are that $700 million or more worth of value could swing to lower- ranking creditors if shareholders dig up sufficient evidence that big investors profited from inside knowledge gained at the Chapter 11 plan bargaining table.
The suspicions are focused on four hedge funds that sat at the bargaining table when Washington Mutual
(WAMUQ:$0.0480,$0.0040,9.09%) hammered out its Chapter 11 distribution scheme: Appaloosa Management LP, Aurelius Capital Management LP, Centerbridge Partners LP and Owl Creek Asset Management LP.
All deny breaching rules that ban trading based on confidential information and say the suspicions are unfounded. The official committee of equity security holders is conducting a probe of the allegations to see if there is sufficient evidence to make a case at confirmation hearings in May.
"We don't know if anyone did anything inappropriately or not," Washington Mutual (WAMUQ:$0.0480,$0.0040,9.09%) attorney Brian Rosen of Weil, Gotshal & Manges said at a hearing in the U.S. Bankruptcy Court in Wilmington, Del.

Washington Mutual (WAMUQ:$0.0480,$0.0040,9.09%) agreed to add information that spells out the financial impact of a potential finding that some or all of the hedge funds profited based on confidential Chapter 11 data to materials that creditors will review before deciding how to vote on the plan. The company has set a May 2 date to seek confirmation of its revamped plan.
In rejecting Washington Mutual's (WAMUQ:$0.0480,$0.0040,9.09%) original Chapter 11 plan, Walrath said the insider-trading allegations, if proven, could warrant a cut in the interest rate some creditors expect to receive. Washington Mutual (WAMUQ:$0.0480,$0.0040,9.09%) has agreed to give senior creditors their contract rate of interest, rather than the minimum required federal judgment rate of interest.
If the shareholders turn up proof of insider trading and the interest rate picture changes, Aurelius likely will switch its vote to a "no" on Washington Mutual's (WAMUQ:$0.0480,$0.0040,9.09%) Chapter 11 plan, said Thomas Moers Mayer, an attorney for the hedge fund with Kramer Levin Naftalis & Frankel.
Monday's ruling moves Washington Mutual (WAMUQ:$0.0480,$0.0040,9.09%) a step closer to ending its stay in bankruptcy, which began in September 2008 when regulators seized WaMu. The mortgage-stuffed thrift was teetering on the brink of collapse, regulators said, and had to be put into safer hands immediately.
J.P. Morgan Chase & Co. (JPM) bought WaMu and, along with the Federal Deposit Insurance Corp., got caught up in a storm of legal trouble over WaMu's collapse. Washington Mutual (WAMUQ:$0.0480,$0.0040,9.09%) , J.P. Morgan and the FDIC eventually agreed to a settlement that forms the core of the Chapter 11 plan Washington Mutual (WAMUQ:$0.0480,$0.0040,9.09%) wants to see put in place.
Recent changes cut the amount of cash that will be paid out immediately if the plan is approved because the company decided to reserve funds for ongoing tax fights. Washington Mutual (WAMUQ:$0.0480,$0.0040,9.09%) says it expects to win those fights and pay off much of its debt, with interest. Shareholders are slated to get nothing under Washington Mutual's (WAMUQ:$0.0480,$0.0040,9.09%) Chapter 11 plan.

ich hab käsepappelblättertee, grins

aber scherz beiseite, so wie diese verhandlung (jetzt nur im ersten eindruck, das kann sich noch ändern) gelaufen ist, schaut es tatsächlich so aus, als ob jpm und fdic von der schippe sind, einen perfekten persilschein erhalten und freilaufen.

ich hoffe zwar noch, das das nicht zutrifft, aber mit wehmut und wenig zuversicht.

und das würde bedeuten, dass wmi/rosen sich mit den aktionären um die reste streitet.

das sollte bei einigermassen ordentlichem ablauf ein schöner batzen sein, wmi zur zeit liegt bei etwa +- 0 (mit den zusätzlichen steuerrückzahlungen) und sollte etwa 10 mrd dollar an steuervorträgen zur verfügung haben.

wenn man den finanziers eine beteiligung um die 10% anbietet, könnte für die aktionäre etwa 9 mrd übrigbleiben. nach abzug der vorzüge (da könnte es noch interessant werden, da ja ein teil der tps halter mit einer abfindung durch jpm (die berühmten 50 mio)  könnte durchaus noch etwas für die stammaktionäre übrigbleiben.

allerdings bin ich, was das "mit rechten dingen" zugehen bei walrat und ihren mitläufern angeht, skeptisch.

I couldn't listen to the hearing but if the ruling/order from the court is asking for a valuation, that can only be good for equity. Why now? Perhaps the court is becoming suspicious. The debtors replied a couple of weeks to the Schorp objection regarding the 2nd and Union subsidiary and their reply was amazingly weak: two old unofficial redacted documents from 2002 and 2003...nothing more...for a 6-figure asset value.

The debtors have never, to my memory, ever said that they didn't own any assets other than what they've listed on the MORs. The MORs list liquid assets but don't have anything for non-liquid assets, non-debtor subsidiaries, etc. They are unaudited and incomplete...and the court is perhaps looking for more. The debtors have always implied that all of the significant assets went with WMB...but they have never actually SAID that anywhere that I can recall. We, the court, and the investment community have been happy to let the debtors string us along with what we wanted to believe...but there was enough smoke raised at the hearing and in the runup to the hearing to trigger the court's response.

The debtors apparently think that Peter J. Solomon's valuation will agree with what they've been saying based on the assumption that if it did not, the EC would have bashed them over the head with it. Since the EC did not, the debtors want the PJS valuation...but it might not be as helpful to the debtors as they think. Susman is a master at the last minute surprise bombshell.

A group representing major commercial banks had asked the high court to reverse a ruling by a federal appeals court that required disclosure of the lending records.

The justices rejected the banks' appeals. The Obama administration said the appeals should be denied.

It said the financial overhaul law adopted last year set new standards on releasing information about emergency lending programs and the law required the disclosure in December of much of the data at issue in the cases.

Bloomberg LP, the parent of Bloomberg News, and News Corp's [NWS  17.70     0.55  (+3.21%)   ] Fox News Network had sought the bailout details under the federal freedom of information law, which requires government agencies make certain documents public.

The two news organizations opposed the appeals, telling the Supreme Court the appeals court decision was correct on the merits and that further delay in releasing the remaining records would be unwarranted under the law.

The appeals court ordered the disclosure of borrowers' names, loan amounts and loan dates for transactions at the Fed's discount window and from its emergency lending facilities.

The Clearing House Association, representing the largest commercial banks that hold more than half of all U.S. deposits, appealed to the Supreme Court, arguing that the emergency lending data should be kept secret.

It said the appeals court ruling threatened numerous federal programs that depend on keeping commercial transactions confidential and could unjustifiably harm the reputation of banks that borrowed from the Fed's discount window.

It was a good day today. Excellent points were made by some incredibly well informed, well prepared and conscientious shareholders. On every objection proffered by a shareholder, JMW was taking notes, and you could see her connecting the dots as the hearing went on.

Even though she didn't outright deny the DS, with the additional information she has ordered to be included, I believe that we will begin to see the trickle down effect. Rosen knows this too, which is why he was so vociferous in his argument. There were some wonderful looks on his and his co-counsel's faces during the hearing.
